b' The FBI and other federal law-enforcement agencies are supposed to operate under the nation\xe2\x80\x99s highest laws, but a recent case from Beverly Hills spotlights the degree to which they routinely and unapologetically trample on the Constitution.The Fourth Amendment upholds the \xe2\x80\x9cright of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures.\xe2\x80\x9d However, operating under \xe2\x80\x9ccivil asset forfeiture\xe2\x80\x9d laws, law-enforcement agencies seize cash and other private property that they merely suspect is the result of criminal activity. Under that dubious process, the owners of the property must prove a negative (that their property is not the result of illegal behavior) to have it returned. The feds designed forfeiture laws during the 1980s drug war as a means to target kingpins, but police agencies apply the laws broadly to ordinary Americans because they keep the seized loot for themselves.Many states, including California, have passed reforms that require the agencies to gain a conviction for the underlying drug crime before confiscating property, but the FBI operates under lax federal standards \xe2\x80\x94 and local agencies often \xe2\x80\x9cpartner\xe2\x80\x9d with federal officials to circumvent tougher state restrictions. This year, the FBI seized $85 million in contents from safe deposit boxes at a company called U.S. Private Vaults. After indicting the company for alleged offenses, the feds \xe2\x80\x9cdidn\xe2\x80\x99t just seize the company\xe2\x80\x99s business property,\xe2\x80\x9d but \xe2\x80\x9cbroke into every security deposit box and emptied them of their contents,\xe2\x80\x9d according to the Institute for Justice, a legal group that defends the property owners .In one instance, they took $57,000 from deposit-box holder Joseph Ruiz. They had no proof of any wrongdoing, but according to news reports argued that he earned insufficient income to have amassed the cash. The money was actually the result of legitimate financial settlements. This situation turns the Constitution on its head. The government should have to prove that money is the result of ill-gotten gains before taking it. Americans shouldn\xe2\x80\x99t have to prove their innocence after the fact. The government returned the cash after a federal judge ruled that the government \xe2\x80\x9cprovides no factual basis for the seizure of Plaintiffs\xe2\x80\x99 property whatsoever.\xe2\x80\x9dHowever, federal agents confiscated cash, jewelry and coins from 800 people. \xe2\x80\x9c(S)ix months after the raid,\xe2\x80\x9d the Los Angeles Times reported, \xe2\x80\x9cthe FBI and U.S. attorney\xe2\x80\x99s office in Los Angeles have produced no evidence of criminal wrongdoing by the vast majority of box holders whose belongings the government is trying to keep.\xe2\x80\x9d One of the FBI\xe2\x80\x99s main arguments is police dogs detected drug scents. As the Times reported, however, the government deposited the money in its bank accounts and didn\xe2\x80\x99t conduct testing to determine which bills contained drug residues \xe2\x80\x94 and dogs often detect cannabis residues even though marijuana is a legal substance in California. Cash passes through many hands.Extensive studies show that drug-sniffing dogs are notoriously unreliable, and their accuracy rates often are no better than a flip of the coin. Some dogs always alert their handlers to the presence of drugs, which reportedly is the result of dogs\xe2\x80\x99 eagerness to please their handlers. The Beverly Hills case shows why it\xe2\x80\x99s past time for Congress to reform federal asset-forfeiture laws and bring them in line with the protections afforded by the Constitution. | ||

Sign up here.) \n1. Coronavirus\n\nMedical experts are warning of another deadly pandemic winter as Covid-19 numbers tick up and flu season threatens. The US is back at a point where more than 2,000 people are dying of Covid-19 every day on average, according to data from Johns Hopkins University. Additionally, about 12,000 to 50,000 Americans lose their lives to flu every year. The best way to avoid another devastating season, doctors say, is to get vaccinated for both. Meanwhile, parts of Southeast Asia, including Indonesia, Malaysia, Thailand and Vietnam, are coming out of long lockdowns and abandoning their \xe2\x80\x9czero Covid\xe2\x80\x9d strategies. Leaders want to revive their countries\xe2\x80\x99 economies, especially their tourism sectors, but experts are worried that low vaccination rates in the region could spell disaster. \n2. United Nations\n\nThe climate crisis was front and center at the UN General Assembly yesterday. Chinese President Xi Jinping recorded a rare address to the UN body promising to halt coal projects, Turkish President Recep Tayyip Erdogan said his country will present the Paris climate agreement to its parliament next month, and US President Joe Biden and UK Prime Minister Boris Johnson stressed further climate action during an Oval Office meeting. An array of international points of conflict were also addressed by the dozens of world leaders present, including nuclear arms in Iran, free and fair elections in Venezuela, and competition between the US and China. The Taliban have also requested representation at this week\xe2\x80\x99s meeting, a move that is expected to kick off a diplomatic battle with the preexisting Afghan envoy. \n3. Congress\n\nProgressive Democrats have announced they will not vote for the $1 trillion bipartisan infrastructure bill without passing the $3.5 trillion package that is aimed at enacting President Joe Biden\xe2\x80\x99s economic agenda. That vote is scheduled for next week, and as it stands, House Speaker Nancy Pelosi can afford to lose only a handful of votes to get anything passed. President Biden will increase his engagement with Congressional Democrats today, including a meeting with Pelosi and Senate Majority Leader Chuck Schumer, to try and get all the Democratic factions in line. Yesterday, the House also passed a bill to avoid a government shutdown and suspend the US debt limit. The bill is unlikely to pass the Senate, so the country is still approaching a possible shutdown and financial precipice in the coming weeks. \n4. Trump revelations\n\nSeveral recent revelations have shed light on then-President Trump and his supporters\xe2\x80\x99 plans to subvert the Constitution and keep him in power after the 2020 election. These revelations are likely to be of high interest to the House select committee investigating the January 6 insurrection. For instance, a newly revealed memo shows a conservative lawyer working with Trump\xe2\x80\x99s legal team tried to convince then-Vice President Mike Pence that he could overturn the election results on January 6 when Congress counted the Electoral College votes. The six-step scheme, which included throwing out electors from seven states, was outlined in a two-page memo obtained by Washington Post journalists Bob Woodward and Robert Costa for their book, \xe2\x80\x9cPeril.\xe2\x80\x9d The memo was then obtained by CNN. \n5. Immigration\n\nThere are about 8,600 Haitian migrants remaining under the Del Rio International bridge in Texas, waiting to be processed by immigration officials and possibly removed from the country. That\xe2\x80\x99s down from a high of about 14,000 earlier in the week, but there are still tens of thousands of other Haitian refugees further south, still waiting for a chance to enter the US. There are up to 30,000 Haitians in Colombia who may be seeking to travel north, and Panama expects 80,000 migrants to cross its borders by the end of this year. South and Central American leaders have expressed concern at the unprecedented flow of migrants. More than 97% of Haitians migrating to the US do not come directly from Haiti, but rather were residents of other countries first. Many Haitians trying to enter the US are believed to have been living elsewhere since the devastating Haiti earthquake in 2010. | ||
